LOCALBITES TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of the LocalBites mobile application, website, and related services (the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms.

1. Company Information

LocalBites is a technology marketplace platform operating at:

LocalBites connects customers with independent restaurants and independent delivery partners.

2. Nature of the Platform

LocalBites is not a restaurant and does not prepare or sell food.

LocalBites provides a technology platform that enables:

  • Customers to place orders

  • Restaurants to prepare food

  • Independent delivery partners to deliver orders

Restaurants are solely responsible for:

  • Food quality

  • Hygiene

  • Preparation accuracy

  • Compliance with health regulations

Delivery partners operate as independent contractors and are not employees of LocalBites.

3. Eligibility

You must be at least 18 years old to use the Platform.

By creating an account, you confirm that:

  • The information provided is accurate.

  • You have legal capacity to enter into binding agreements.

4. Account Registration

Users may register using Google authentication.

You are responsible for:

  • Maintaining the confidentiality of your account

  • All activity conducted under your account

LocalBites reserves the right to suspend or terminate accounts involved in fraud, abuse, or policy violations.

5. Orders and Acceptance

An order is considered confirmed only after:

  1. Payment authorization is successful; and

  2. The restaurant accepts the order.

Once a restaurant accepts an order and begins preparation:

  • The order cannot be cancelled.

  • Refunds will only be issued under the Refund Policy.

Restaurants may reject orders due to stock unavailability or operational constraints.

6. Pricing and Fees

The total amount payable may include:

  • Menu item price

  • Service fee

  • Delivery fee

  • Applicable taxes (if applicable)

  • Promotional adjustments

All fees are displayed before checkout confirmation.

LocalBites reserves the right to modify fees at its discretion.

7. Payments

Payments are processed through secure third-party payment providers.

LocalBites does not store complete card information.

In case of payment failure:

  • The order may not be processed.

  • Users remain responsible for valid payment completion.

Chargeback abuse may result in account suspension.

8. Delivery

Delivery times are estimates only.

LocalBites is not liable for delays caused by:

  • Traffic

  • Weather

  • Restaurant preparation time

  • Events beyond reasonable control

Customers must provide accurate delivery details and remain available to receive the order.

Failure to receive an order due to customer error may result in no refund.

9. Refunds and Cancellations

Refunds and cancellations are governed by the LocalBites Refund Policy.

Generally:

  • Orders may be cancelled before restaurant acceptance.

  • Once accepted, cancellations are not permitted.

  • Refunds may be granted for wrong, missing, undelivered, or significantly compromised orders.

LocalBites reserves the right to investigate refund claims.

10. User Conduct

Users agree not to:

  • Engage in fraudulent activity

  • Abuse promotions or discounts

  • Harass delivery partners or restaurant staff

  • Use the platform for unlawful purposes

  • Attempt to disrupt or interfere with platform operations

Violations may result in account suspension or termination.

11. Intellectual Property

All content on the Platform, including logos, software, text, and design elements, is owned by or licensed to LocalBites.

Users may not reproduce, modify, or distribute any content without written permission.

12. Limitation of Liability

To the maximum extent permitted by law:

LocalBites shall not be liable for:

  • Food quality issues

  • Allergic reactions

  • Restaurant errors

  • Actions of independent delivery partners

  • Indirect or consequential damages

LocalBites’ total liability shall not exceed the total value of the order giving rise to the claim.

13. Indemnification

Users agree to indemnify and hold harmless LocalBites from any claims, damages, or liabilities arising from:

  • Misuse of the Platform

  • Breach of these Terms

  • Violation of applicable laws

14. Termination

LocalBites may suspend or terminate access to the Platform at its discretion if:

  • These Terms are violated

  • Fraudulent behavior is detected

  • Continued access poses legal or operational risk

15. Force Majeure

LocalBites shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, civil unrest, power outages, or government restrictions.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Lesotho.

Any disputes shall be subject to the jurisdiction of the courts of Lesotho.

17. Amendments

LocalBites reserves the right to update these Terms at any time.

Updated Terms will be published on the Platform with a revised effective date.

Continued use of the Platform constitutes acceptance of revised Terms.
