LocalBites Driver Terms and Conditions

These Driver Terms and Conditions (“Terms”) govern your access to and use of the LocalBites platform as a delivery driver (“Driver”, “you”).

By registering or using the LocalBites Driver App, you agree to be bound by these Terms.

1. Role of LocalBites (Platform Role)

LocalBites is a technology platform that connects:

Customers placing orders
Store partners preparing orders
Independent drivers fulfilling deliveries

LocalBites does not employ drivers and is not a transportation or logistics company.

2. Independent Contractor Status

You agree that:

You are an independent contractor, not an employee
You are responsible for your own:
- Taxes
- Insurance
- Fuel and vehicle costs
Nothing in these Terms creates:
- Employment
- Partnership
- Joint venture

3. Driver Account

To use the platform, you must:

Provide accurate and complete information
Maintain the security of your account
Not share your account with others

We reserve the right to:

Approve or reject driver applications
Suspend or terminate accounts at our discretion

4. Availability and Acceptance of Orders

You are free to go online or offline at any time
While online, you may receive delivery requests
You are not obligated to accept every request

However:

Consistently low acceptance or high cancellation rates may affect your access to the platform

5. Delivery Responsibilities

When you accept an order, you agree to:

Pick up and deliver orders promptly
Follow reasonable directions from the app
Handle items with care
Maintain professional conduct

You are responsible for:

Ensuring timely and accurate deliveries
Communicating issues through the app

6. Use of Location Tracking

By using the platform, you agree that:

Your location will be tracked while you are online
Your location will be shared with customers and store partners for active deliveries

You may stop tracking at any time by going offline.

7. Payments and Fees

7.1 Driver Earnings

Drivers are paid based on:

Delivery fees per order
Any applicable incentives or bonuses

7.2 Payment Processing

Payments may be processed through third-party providers
Processing fees may apply

7.3 Adjustments

LocalBites reserves the right to:

Adjust payments in cases of:
- Fraud
- Order disputes
- System errors

8. Driver Ratings and Performance

Drivers may be evaluated based on:

Delivery time
Acceptance rate
Customer feedback
Reliability

LocalBites may:

Limit access
Suspend or remove drivers
based on poor performance or misconduct.

9. Prohibited Conduct

You agree NOT to:

Use the platform for illegal activities
Tamper with or steal orders
Misrepresent deliveries
Harass customers or store staff
Share customer information outside the platform
Use another person’s account

Violation may result in immediate suspension or termination.

10. Safety and Compliance

You agree to:

Follow all applicable traffic laws
Maintain your vehicle in safe condition
Hold any required licenses or permits

LocalBites is not responsible for:

Accidents
Injuries
Damages incurred during deliveries

11. Device and Network Requirements

You are responsible for:

Having a compatible smartphone
Internet access and data costs
Battery usage

LocalBites is not responsible for:

Connectivity issues
Device malfunctions

12. Suspension and Termination

We may suspend or terminate your account if:

You violate these Terms
You engage in fraud or misconduct
Your performance falls below acceptable standards

You may stop using the platform at any time.

13. Limitation of Liability

To the maximum extent permitted by law:

LocalBites shall not be liable for:

Loss of income
Indirect or consequential damages
Issues arising from deliveries

Your use of the platform is at your own risk.

14. Indemnification

You agree to indemnify and hold LocalBites harmless from:

Claims
Damages
Losses

arising from:

Your actions
Your violation of these Terms
Your breach of applicable laws

15. Changes to the Platform

We may:

Modify features
Change pricing or payment structures
Update policies

at any time without prior notice.

16. Updates to These Terms

We may update these Terms from time to time. Continued use of the platform means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of Lesotho.
